Terms of Service

These Terms of Service (the "Terms") set out the conditions for using "HexScope | AI Brand Tracker" (the "Service"), which Hexagonal Computation, Inc. (the "Company") provides at https://hexscope.ai.

Anyone who uses the Service (a "User") does so on the basis that they agree to these Terms.

  1. 1.Scope

    These Terms apply to all relations between the Company and Users concerning use of the Service. Under Japanese law, these Terms constitute standard-form terms (teikei-yakkan) within the meaning of Article 548-2 of the Civil Code.

    Notices and guidance that the Company presents separately within the Service form part of these Terms. If these Terms conflict with such separate provisions, the separate provisions prevail.

    The handling of personal data is governed by the separate Privacy Policy.

  2. 2.Definitions

    In these Terms, the following terms have the meanings set out below.

    • "Service" means the service provided by the Company at hexscope.ai that measures how brands are mentioned in the answers of AI platforms and delivers the results as a report.
    • "Report" means the measurement result that the Service generates and sends to the email address specified by the User.
    • "Measurement Target" means the domain a User enters into the Service and the brand identified from that domain.
    • "AI Platform" means a third-party generative AI service used by the Company for measurement, such as ChatGPT (OpenAI), Gemini (Google), Perplexity, and Claude (Anthropic).
  3. 3.The Service

    The Service retrieves and analyzes the public pages of the domain entered by the User, sends questions generated from that analysis to several AI Platforms, aggregates how the Measurement Target is mentioned in the responses, and produces a Report.

    Reports are not shown on screen; they are sent to the email address specified by the User.

    The Company provides measurement only. Implementing measures to increase exposure on AI, consulting, and content production are not part of the Service.

  4. 4.Nature of measurement results

    Measurement results are observations based on the responses of AI Platforms at the time the measurement was carried out. Because generative AI responses can vary even for the same question, the Company does not guarantee that measurement results are reproducible.

    The Company does not warrant the accuracy, completeness, timeliness, or fitness for any particular purpose of the measurement results.

    Changes to an AI Platform’s specifications, models, terms of provision, or terms of use may make part or all of the measurement impossible to continue, or may cause the measurement method to change.

    A Report presents measured values and is not legal, tax, investment, marketing, or other professional advice. Users evaluate and use it at their own responsibility.

    The Service provides measurement and does not guarantee or promise that the visibility of the Measurement Target on any AI Platform will improve.

  5. 5.Users

    The Service manages usage through an anonymous identifier issued per browser, to the extent necessary to deliver Reports and manage the free allowance.

    By using the Service, Users represent and warrant that they are at least 16 years old.

    Users are responsible for ensuring that the email address they enter is one they control and is accurate.

  6. 6.Fees and payment

    The Service may be used free of charge up to three times per User (identified by an anonymous identifier issued per browser).

    Use after the free allowance is exhausted is chargeable. The fee is JPY 500 per Report in Japanese, and USD 5 per Report in other languages. From the third chargeable use onward within the same calendar month (based on Coordinated Universal Time), the fee is JPY 400 or USD 4 per Report. The applicable currency and taxes are as shown on the checkout screen.

    Payment is processed through the payment service provided by Stripe, Inc. Card details are sent directly from the User’s browser to Stripe and do not pass through the Company’s servers or databases.

    The Company may revise its fees. Revised fees apply to orders placed after the revised fees are displayed within the Service.

  7. 7.Refunds and cancellation

    A Report is digital content that is generated and sent immediately after an order is received. When placing a paid order, the User agrees that the Company begins provision immediately.

    The Service can be tried using the free allowance before any paid order. After delivery of a Report is complete, a refund may not be available due to the nature of the content.

    If the Company is unable to provide a Report for reasons attributable to the Company, the Company will respond by resending the Report or refunding the amount paid.

    Where a User who is a consumer has a right of withdrawal under the laws of their country of residence, this section does not restrict that right.

  8. 8.Prohibited conduct

    When using the Service, Users must not engage in the following conduct.

    • Conduct that violates laws or public order and morals
    • Using the Service for the purpose of infringing the rights of third parties
    • Reverse engineering, decompiling, or otherwise analyzing the Service
    • Sending a large volume of requests by automated means, or otherwise placing an excessive load on the Company’s systems
    • Reselling Reports to third parties, or redistributing them repeatedly and continuously without the Company’s permission
    • Using the Service by impersonating another person
    • Any other conduct that the Company reasonably determines to be inappropriate
  9. 9.Intellectual property

    Intellectual property rights in the Service, the software that constitutes it, its screen displays, its measurement methods, and the format of Reports belong to the Company or its legitimate rightsholders.

    The Company grants Users the right to use Reports they receive internally for their own business or operations. If you publish or quote all or part of a Report, please attribute the source as "HexScope | AI Brand Tracker."

    A Report may include third-party trademarks or names as part of the measurement results. This does not mean that the Company has any partnership, endorsement, or other relationship with that third party.

  10. 10.Data entered by Users

    The User agrees that the Company may access the public pages of the entered domain and analyze their content for measurement.

    The User is responsible for ensuring that carrying out measurement in relation to the entered domain does not infringe the rights of third parties.

    When accessing a target site through its crawler, the Company takes reasonable care not to place an excessive load on that site.

  11. 11.Use of third-party services

    The Service uses third-party services for AI Platforms, cloud infrastructure, payment, and email delivery. The providers used are listed in the Privacy Policy.

    The Company is not responsible for the operation, specifications, terms of provision, or changes of these third-party services.

  12. 12.Changes, suspension, and termination of the Service

    The Company may change the content of the Service, or suspend or terminate the Service.

    The Company may suspend the Service without prior notice in the event of maintenance work, system failures, suspension of third-party services, or other unavoidable circumstances.

    If the Company terminates the Service, it will endeavor to give reasonable prior notice by an appropriate method.

  13. 13.Disclaimer of warranties

    The Company does not warrant that the Service will be provided without interruption or that the Service is free of defects.

    The Company does not warrant that Users will obtain the results they expect from using the Service.

  14. 14.Limitation of liability

    Where a User suffers loss due to the Company’s breach of contract or tort, the Company’s liability, only in cases of the Company’s slight negligence, is limited to the total amount of fees the User has paid to the Company up to the point at which the loss arose.

    The preceding paragraph does not apply where the Company has acted with intent or gross negligence.

    The Company is not liable for lost profits, lost business opportunities, or other indirect or special damages. This does not apply where the Company has acted with intent or gross negligence.

    For a User who is a consumer, if all or part of this section does not apply under the mandatory laws of their country of residence, those mandatory laws prevail.

  15. 15.Handling of personal data

    The Company handles personal data obtained in providing the Service in accordance with the separate Privacy Policy.

  16. 16.Changes to these Terms

    The Company may change these Terms.

    A change will be made where it conforms to the general interests of Users, or where it does not conflict with the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances.

    When changing these Terms, the Company will give notice of the content after the change and the time it takes effect, by posting it within the Service before the effective time.

  17. 17.Governing law and jurisdiction

    These Terms and use of the Service are governed by the laws of Japan.

    In the event of a dispute between the Company and a User concerning the Service, the Tokyo District Court has exclusive jurisdiction as the court of first instance by agreement.

    The preceding two paragraphs do not deprive a User who is a consumer of the protection of the mandatory laws of their country of residence or of the right to bring proceedings in the courts of that country.

  18. 18.Language

    These Terms are provided in Japanese, English, Spanish, German, French, and Italian.

    If there is a discrepancy between the language versions, the version more favorable to a User who is a consumer applies to that User. Otherwise, the Japanese version prevails.
